KYIV, UKRAINE

On April 24, Oleksiy Feliv, Managing Partner at IMPACTA LAW, moderated a session dedicated to investments in decentralized generation during the III Investment Forum of the Ukrainian Bar Association.

In the wake of systemic attacks on energy infrastructure, the development of distributed capacities has transitioned from a security necessity to a strategic imperative for Ukraine’s economic recovery. The discussion convened representatives from major investment funds and leading market participants to identify viable financing mechanisms for energy independence. Despite the ongoing conflict, market activity remains resilient; the decentralization of power generation is fundamentally reshaping the architecture of Ukraine’s energy grid. Furthermore, the readiness of international investors to commit to renewable energy projects serves as a vital signal of market confidence.

Integration into the European energy market mandates that Ukrainian projects adhere to rigorous standards of transparency and operational excellence. A critical success factor lies in transforming energy initiatives into 'bankable' assets - modeled after the business clarity of commercial real estate - to appeal to international financial institutions. This sector's potential is underscored by Ukraine’s vast natural resources and an acute demand for maneuvering capacities, which together are forging a new landscape for energy consumption.

Panelists highlighted a significant shortage of 'ready-to-build' projects that satisfy stringent international compliance and ESG criteria. To effectively secure debt financing, investors require not only market potential but also robust military risk insurance mechanisms and transparent legal transaction frameworks. While new legislation - specifically Law No. 4777-IX regarding the modernization of "green" auction rules - establishes a favorable regulatory environment, its practical execution hinges on meticulous and high-quality pre-project preparation.

Expert legal counsel has evolved into an indispensable component of business strategy throughout every stage of project implementation. Investment success within the energy sector is inextricably linked to the depth of due diligence, professional assessment of regulatory risks, and sophisticated risk management. Ukraine possesses a singular opportunity to develop the most advanced energy system in Europe - a path that demands legally sound decisions and transparent 'rules of the game'. IMPACTA LAW remains dedicated to supporting clients in advancing strategic initiatives that fortify the sustainable development and energy security of our nation.
