IMPACTA LAW secures favourable LCIA consent award for a Ukrainian energy company

IMPACTA LAW represented a Ukrainian energy company as claimant in an LCIA arbitration against a major international management consulting and investigations firm.

The dispute arose from a procurement contract under which the respondent undertook to provide financial investigation and related services, involving subcontractors in both the United States and Ukraine. The contract was governed by the laws of England and Wales. The arbitration concerned disagreements regarding the scope and quality of services, as well as potential exposure to Ukrainian currency control penalties due to delays in performance.

At the initial stage of the arbitration, the firm secured disclosure of key documents relating to the performance of the contract that had not been previously available to the client. It also obtained a stay of the proceedings to allow for a detailed review of the disclosed materials, which became a turning point in the case and enabled the client to strengthen its position in negotiations.

Following this, the parties engaged in settlement discussions and reached an amicable resolution. The dispute was concluded by way of a settlement agreement followed by an the tribunal’s consent award on terms favourable to the client.
